Pools and Lawsuits

Spring is here! Let’s face it, in South Florida, it already feels like summer weather. This means that children are already splashing around in the pool trying to cool off from the heat. The Centers for Disease Control and Prevention reported that about ten people die from unintentional drowning per year. According to the Florida Department of Children and Families, “the state loses more children under the age of five to drowning.”

The cause of drowning is often due to malfunctions with pool equipment. South Florida has seen a current rise in children jumping into a pool and getting electrocuted. This causes immediate death and is grounds for a wrongful death lawsuit. Often the manufacturer of the equipment is responsible. Sometimes the pool equipment has become rusty and old which also causes a dangerous situation.

Since it already feels like summer has arrived in South Florida, here are some pool safety measures you should consider.

  • Supervision – Any parent of a child that has drowned or become injured while swimming in a pool will tell you it happens fast! In a blink of an eye, your child can lose their life in a swimming pool. As a parent, you always want to be vigilant and watch your children closely as they swim and play in the pool
  • Pool Maintenance – As mentioned above, pool equipment can rust or become old and not work properly. Before pool season begins, have a professional inspect your pool and conduct any maintenance necessary.
  • Slick Surfaces – Have you ever seen someone slip and fall near a pool? A slippery surface is dangerous and can cause serious injury. If you own a pool, invest in non-slick surfaces for safety. If you live in an apartment complex or share a public pool, teach your children about pool safety and to avoid running around or near the pool. Unfortunately, many slip and fall accidents happen around pools due to the exposure to water on the surface surrounding the pool.
  • Pool Covers – Invest in a pool cover for safety issues. Pool covers come in a variety of different sizes and styles that will suit a wide range of pool designs. Pool covers are responsible for keeping the pool water clean as well as preventing accidental drowning.

If you or a family member has slipped and fell, become injured or died due to issues with a pool it is important that you contact an attorney immediately.
